The Munich Local Division (Zigann presiding, Pichlmaier rapporteur) issued one of the first UPC Zwangsgeld (penalty payment) orders under Art. 82(4) UPCA for violations of the 19 September 2023 ex-parte PI in the 10x Genomics v NanoString dispute over EP 4 108 782. Leitsatz 1: PI orders under Art. 62 UPCA are enforceable via Zwangsgeld without a further enforcement order — R. 354.1 RoP makes them 'sofort vollstreckbar' on CMS service. Leitsatz 2: Art. 82(4) UPCA exhaustively regulates the conditions for imposing a Zwangsgeld; national enforcement rules (e.g. German Parteizustellung, French bailiff service) are irrelevant at this stage. Leitsatz 3: R. 118.8 RoP expressly covers only orders under R. 118.1 and R. 118.2(a) and does not apply to Art. 62 UPCA orders. On the merits, multiple website offerings of the CosMx system in UPC Contracting States without the mandatory disclaimer, the promotion of RNA detection during post-order trade events (Paris/Frankfurt), missing/insufficiently prominent disclaimers in the Instrument User Manual and Manual Slide Preparation, and an offer of a product-presentation tour at the Amsterdam CX-Lab all breached the PI. Because the violations stemmed from a single cause — failure to update the corporate web presence promptly — the panel imposed a single combined Zwangsgeld of EUR 100,000 rather than the per-Ziffer amounts sought. The panel also clarified the dual Beuge + punitive nature of the Zwangsgeld, drawing on the English ('penalty payment'/'be sanctioned') and French ('sanctionnée') text, which implies an unwritten fault (Verschulden) requirement. Appeal was expressly allowed because of the first-instance novelty of the ruling.
