routine
The Brussels Local Division allowed the parties to withdraw the whole of two connected sets of proceedings — an order to preserve evidence and an order for inspection, together with the applications for a penalty payment, for protection of confidential information and for the destruction and deletion of confidential information still pending in them. It treated the application as admissible because no final decision had been given in any of the pending procedures, which is the condition R. 265.1 RoP imposes, and granted it on the parties' joint request. Both the absence of a cost decision under R. 265.2(c) RoP and the absence of any reimbursement of court fees under R. 370.9(b) RoP rest on the parties' own declarations: they confirmed that each bears its own costs, and expressly waived reimbursement in view of the advanced stage of the proceedings. The decision shows a saisie and an inspection being unwound in full by agreement, with the confidentiality applications that survived them going the same way.
