The Mannheim Local Division fixed the costs of first-instance infringement proceedings after the Court of Appeal had set aside the first-instance decision, dismissed the infringement action and placed the costs of both instances on the claimant. Only one head of cost was contested and it was refused: the costs of preparing and filing the cost application itself. Following the Court of Appeal in Hanshow v VusionGroup, Philips v Belkin and Niche Biomedical v Onward Medical, each party bears the costs it incurs in the cost decision procedure, the appeal court fee excepted, and Art. 69 UPCA does not reach them because it governs proceedings in which the allocation of costs is a consequence of the outcome rather than the subject-matter. The applicants' contrary reading — that drafting the R. 151 RoP application is a cost of the main proceedings and that Hanshow concerns only subsequent litigation about those costs — was rejected. Representation, travel and Korean-law expert costs apportioned equally with the parallel proceedings UPC_CFI_162/2024, and the repayment of a EUR 56,000 interim cost award, were unopposed and allowed in full.
