After the Court of Appeal set aside the Mannheim Local Division's infringement decision of 11 March 2025 and dismissed the underlying infringement action, the claimant Hurom withdrew its Application for a cost decision under Rule 150 RoP related to UPC_CFI_159/2024. The Mannheim LD (judge-rapporteur Böttcher, sitting alone) permitted the withdrawal, applying Rule 265 RoP by analogy as recently endorsed by the Court of Appeal in Niche Biomedical v Onward Medical (UPC_CFI_60/2026, 27 April 2026). The court further held — following CoA Hanshow v VusionGroup (UPC_CoA_618/2025, 6 June 2025, [54]) — that no separate decision on the costs of the R. 150 RoP cost proceedings was warranted: as a rule, each party bears its own costs in cost-decision proceedings (with the limited exception of the appeal court fee), and no exceptional circumstances under Art. 69(3) UPCA were present here.
