Endgültige Anordnung einer Vertraulichkeitsanordnung und Zugangsbeschränkung nach Regel 262A. Bestimmung und Glaubhaftmachung von Geschäfts- und Betriebsgeheimnissen. Zuverlässige Personen

notable
The Hamburg LD (judge-rapporteur Schilling) issued a final R. 262A RoP confidentiality order following an earlier interim order, protecting Tesla's technical implementation details of the accused power-management components (Statement of Defence § C.IV.3(c), Exhibit B 2) and its chip purchase prices (§ D.I.2.a)(4)) as trade/operational secrets, while rejecting confidentiality for Exhibit B 4 (extrajudicially shared with Avago without recipient limitations) and the projected sales-result calculations (§§ D.I.2.a)(5), E.II) (pure multiplication of publicly available figures without internal business inputs). The court held that the R. 262A RoP standard of proof is the 'überwiegende Wahrscheinlichkeit' (preponderance of probability) — consistent with Art. 9(1)(2)(a) Directive (EU) 2016/943 and Art. 58 UPCA, which include 'alleged trade secrets'. R. 262A RoP addresses confidentiality vis-à-vis the other party in the proceedings, while R. 262.2 RoP addresses confidentiality vis-à-vis non-party third parties. For the designated persons under R. 262A.6 RoP the court confirmed that they need not be employees of the party itself — employees of an affiliated group company (Broadcom Inc., parent of Avago) are acceptable, reflecting the common practice of separating IP holding from operating entities. The balance under R. 262A.5 RoP was satisfied by limiting access to counsel and three named group employees.
