routine
The Hague Local Division, sitting as a full panel, allowed the withdrawal of three parallel infringement actions on standard-essential patents after the claimant settled with every defendant, and declared the proceedings closed. Where the application to withdraw was not signed by the defendants, the Court set a deadline for confirmation and treated a defendant's silence as agreement. It held that the Rules of Procedure as amended on 1 January 2026 govern applications for withdrawal and reimbursement filed in 2026, following Court of Appeal case law, so the claimant was in principle entitled to reimbursement of 50% of the court fees under R. 370.9(b) RoP. The Court then invoked R. 370.9(e) RoP to halve that entitlement to 25%, deeming the situation exceptional because of the claimant's own procedural behaviour: parallel filings at different divisions requiring coordination, the splitting of the original case into three, more than ten applications, and two case management hearings, all in proceedings that never got past the statements of defence. No further cost decision was needed because the parties had agreed each would bear its own costs.
