⚖️Infringement Action

notable
On the day after dismissing a first R.9.3 RoP extension request, the Hague Local Division (judge-rapporteur Kokke) grants a renewed R.9.3 + R.263 RoP application by the Transsion defendants and extends the combined non-technical Statement of Defence deadline by two weeks to 29 May 2026. The renewed application is granted because the Transsion defendants submitted new prima facie relevant information that could not have been considered when the prior order was issued — in particular, the first-time disclosure that a FRAND defence will be filed and a narrowed access request limited to one specifically named in-house individual (versus the earlier nine). The court also notes that, unlike the previous open-ended request, the new extension is specific and bounded (two weeks, coinciding with the technical SoD deadline in the parallel case 1793/2025), and that issuing the extension avoids rendering the parallel R.333 RoP review application moot. The order sets a tight schedule for both parties to submit updated R.262A confidentiality-regime positions and a longer window for Ericsson's response to the R.333 RoP revision application.
