In the Ericsson v Transsion SEP/FRAND dispute, The Hague Local Division (panel: Brinkman presiding, Kokke JR, Granata, Keller TQJ) set a combined R. 262A/262.2 RoP confidentiality regime across the three split infringement cases. It classified the licensing-negotiation correspondence and Ericsson's comparable-licence material (the 'Ericsson Restricted Information', including the Mills Report) as confidential under Art. 58 UPCA and R. 262.2 RoP and excluded it from public inspection. Applying the Court of Appeal's confidentiality-club jurisprudence (R. 262A.5/.6), it ordered a phased 'external eyes only' regime for the comparable licences in Phase 1 — access limited to the defendants' UPC representatives and an external valuation expert — because the relevance of the 20-plus comparable licences to the case is not yet established; postponing in-house access until relevance is shown does not breach the right to a fair trial or effective remedy. It held that the CoA's default of at least one in-house natural person per party is displaced here, where the defendants share representation, plead jointly, and only Transsion (defendants 1-4) is directly involved in licensing, with two in-house recipients for all defendants reasonable if access later becomes relevant. A culpable breach carries a penalty of up to EUR 1,000,000 (R. 354.3/.4). The court dismissed the residual R. 9.3 extension request and the R. 333 review application as devoid of purpose (R. 360), and deferred Ericsson's R. 190 disclosure application.
