no impact of Sec. 25(1) German Patent Act on the admissibility of an infringement action before the UPC
The Mannheim Local Division rejected an application to dismiss an infringement action under Rule 361 or Rule 362 due to neglecting the obligations under Section 25 (1) of the German Patent Act. The Court stated that said section was not applicable to actions before the UPC and clarified that even if it was applicable, Rules 361 and 362 would still not justify a dismissal of the case.
