The Düsseldorf Local Division permitted the withdrawal of an infringement action and of the counterclaim for revocation under R. 265.1 RoP after the parties settled out of court, and declared the proceedings closed. Because the parties had agreed that each bears its own costs and none would seek reimbursement, the Court held a cost decision unnecessary but recorded the no-compensation agreement in the order for clarity at the Claimant's request. It declined the Claimant's request to confirm explicitly that the Court must pay the court fees. Each side was reimbursed 50% of the court fees for its own action under R. 370.11 and R. 370.9(b) RoP as applicable since 1 January 2026, because the withdrawal came before the closure of the written procedure.
