The Hamburg Local Division (judge-rapporteur Schilling) dismissed Xiaomi's applications for a summary rejection under Rule 334(h) RoP of Nera's claim-amendment requests (R. 263 RoP) and the underlying contingent patent-amendment requests (R. 30 RoP). The JR held that the auxiliary defence of the patent under Rule 30.1(b) RoP is not subject to a separate leave regime by the court — claimants are free to introduce auxiliary amendment requests to defend against a revocation counterclaim. Only the related R. 263 claim amendments are subject to leave, and that leave cannot be refused so long as the underlying patent-amendment requests meet the content requirements of Rule 30.1(b). Substantive admissibility questions — including the defendants' challenges based on divergence, number of auxiliary requests, clarity (Art. 84 EPC) and added-matter/scope (Art. 123(2) and (3) EPC) — are matters of substance that require the full panel to engage deeply with the patent and cited prior art, and are therefore reserved for the oral hearing / final decision. The JR articulated that procedural economy cuts both ways: it does not normally require the panel to make an early Rule 334(h) RoP decision on questions of substantive scope of this magnitude.
