The Mannheim Local Division determined the costs of an infringement action and its counterclaim for revocation, the merits decision having apportioned them 25% to the claimant and 75% to the defendants. Both sides had agreed out of court to recognise EUR 360,000 each as reasonable and proportionate legal costs and expenses under Article 69(1) UPCA, and each applied the ratio in its favour to that figure and to the court fees it had paid. The Court accepted the agreement, the agreed total being below the applicable ceiling and there being no dispute or doubt that costs of at least that amount had been incurred, and ordered both cross-liabilities in the same decision without setting them off: EUR 288,000 payable by the defendants and EUR 95,000 by the claimant, both by a fixed date three weeks later.
