routine
In this scheduling order the judge-rapporteur of the Munich Local Division declined to rule for the time being on the defendants' application to postpone the oral hearing set for 14 May 2024. He gave the defendants the opportunity to advance further grounds for the necessity of an interim conference — grounds arising in connection with the application to amend the patent — in the Rejoinder due under Rule 32.3 RoP on 8 May 2024. Under Rule 101.1 RoP he will decide whether to hold an interim conference only once that Rejoinder is in. Because the postponement application depends on that prior question, there was no cause to decide it now. The order closes with an express warning that an interim conference is not mandatory and that, if none is held, the parties should expect the postponement application to be dismissed.
