Zusammenfassung: The Mannheim Local Division, acting through judge-rapporteur Tochtermann, ordered under Rule 303.2 RoP the severance of the infringement proceedings against the defendants domiciled in mainland China (Xiaomi Inc., Beijing Xiaomi Mobile Software, Xiaomi Communications) and Hong Kong (Xiaomi H.K. Limited) from the main action against the EU-based Xiaomi subsidiaries and two German re-sellers. Representation of the EU-based defendants did not extend to the Chinese/Hong Kong entities, and an earlier attempt to treat service on the German Xiaomi subsidiary as service on the non-EU defendants under Rule 275.2 RoP had been refused. Because service on the mainland Chinese and Hong Kong defendants must proceed under the Hague Service Convention and will take considerable time, severance was warranted to allow the main action to proceed expeditiously against the already-represented defendants. Two new proceedings are to be opened in the CMS with separately set provisional amounts in dispute (EUR 1.2m and EUR 400k respectively).
