It is justified under R. 316A.1 RoP that the supplier, even if he refuses to intervene, is bound by the decision given in the infringement action brought against the distributor. The intervention will not have the effect of prolonging the duration of the proceedings to a decisive extent, since the time limits are strictly governed by R. 316A.2 RoP.

notable
The Paris Local Division granted the defendant Laser Components' R. 316A RoP application for forced intervention of its chip supplier Photon Wave into an ongoing infringement action brought by Seoul Viosys. The Court held that the defendant had a direct interest in joining its supplier because it enjoyed a right of recourse under Art. 43 CISG and could seek warranty coverage for any infringement award. The claimant's objection that forced intervention would unduly prolong proceedings was rejected because the time limits in R. 316A.2 RoP are strictly governed. The supplier will be bound by the infringement decision even if it declines to intervene, and the order itself is not appealable under R. 317 RoP.
