⚖️Counterclaim for revocation
🌐English

routine
The Judge-Rapporteur of the Brussels Local Division issued the order following the interim conference (R. 105.5 RoP) in an infringement action and counterclaim for revocation. The value was set by agreement at EUR 8M for the infringement action and EUR 12M for the counterclaim (value plus 50% under point II.2.b of the court-fee Guidelines), with recoverable costs to be agreed and reported by 16 November 2026. The parties were directed to take a conclusive position on whether an international-jurisdiction objection can still be raised after the R. 20 RoP order, in light of R. 19.7 RoP and Art. 26(1) Brussels Ia, and to address the anchor-defendant question and the law governing joint liability. The order also admits short, neutral claim-construction clarifications without new arguments and sets a procedure for keeping confidential parts of the oral hearing and the decision protected.
