routine
The Düsseldorf LD applied the two-stage test under R. 109 RoP to a Japanese claimant's request for simultaneous German-to-Japanese interpretation at the oral hearing. At the first stage it held interpretation appropriate, because representatives attending in person do not command the language of proceedings and could otherwise neither follow nor contribute to the hearing; the claimant may therefore engage interpreters at its own expense under R. 109.4 RoP and use the courtroom equipment. At the second stage it refused to let those costs become costs of the proceedings under R. 109.5 and R. 150 RoP: the claimant is not challenged by the language of proceedings to any greater degree than is usual before a multilingual international court, and its interests are represented by its German-speaking representatives. The Court expressly held that neither the defendants' alleged infringing acts as the occasion for the action, nor the revocation counterclaim, nor whether the patentee had expanded its business into UPCA territory alters that assessment. Attendance by videoconference was permitted under R. 112.3 first sentence (a) RoP.
