The Paris Local Division issued the order recording the decisions taken at the online interim conference of 29 July 2026 in the parallel Sun Patent Trust v Vivo infringement action and its counterclaim for revocation (R. 105.5 RoP). The conference was held by Webex and audio-recorded under R. 106 RoP; the parties confirmed that settlement negotiations continue. The Judge-rapporteur fixed the value in dispute at EUR 5 million for the infringement action and the same amount for the counterclaim, giving a total of EUR 10 million, the claimant's figure being undisputed, and ordered the parties to file by 28 August 2026 a consolidated statement of the operative parts of their requests and a confirmation of their agreement on recoverable costs. For the oral hearing on 9 to 11 September 2026 the Judge-rapporteur divided the days by subject matter: the technical days remain public and only the day devoted to the FRAND defence, corrective measures and the interim award is held in private. The order determines no substantive issue and reserves claim construction, added matter, infringement and the FRAND defence to the hearing.
