Enforcing a provisional-measures order of 9 December 2025 concerning EP 2 131 940 B1, the Hamburg Local Division fixed further penalty payments under R. 354 RoP against a Chinese defendant that had ignored the order and defaulted. The Court reaffirmed that, although R. 118.8 sentence 1 RoP does not apply to provisional-measures proceedings, every penalty-payment order under R. 354.4 RoP must rest on a prior threat (Androhung) contained either in the operative part of the main order or in a further order (following the Court of Appeal in Kodak/Fujifilm, UPC_CoA_699/2025). The amount of a penalty is set by reference to the importance of the order (R. 354.4 RoP; Art. 82(4) UPCA) — assessed by the type, extent and duration of the breach, the degree of fault, the infringer's advantage and the dangerousness of the infringement (following Belkin v Philips, myStromer v Revolt Zycling and 10x Genomics v NanoString). For the unfulfilled information obligation the Court applied the previously-threatened maximum of EUR 1,500/day given the elapsed time and persistent non-cooperation (EUR 105,000), and for continued website advertising in breach of the injunction it fixed EUR 500/day over 195 days (EUR 97,500), placing on the defendant the burden of showing the infringing offer was recent. It threatened a further EUR 2,000/day and stressed that any further increase of a recurring penalty requires a fresh threat.
