This order records a case-management hearing in the Dolby v Acer infringement action over EP 3 079 153, essential to the Opus audio codec and part of the Vectis patent pool (Dolby, Fraunhofer, NTT; 300 granted patents in 17 families). Because confidential information was to be discussed, the hearing was held online 'behind closed doors', with a final part also confidential vis-à-vis the pool administrator Vectis. The judge-rapporteur urged the parties to continue pool negotiations, offering a possible preliminary opinion on sticky points, and noted a parallel Opus case that could serve as a FRAND benchmark. Dolby indicated the patent is not subject to a FRAND declaration though it is in the pool, which affects the applicability of Huawei v ZTE. The status of Acer's R. 190 RoP licence-disclosure request and Acer's intention to file a rate-setting counterclaim also against Vectis (opposed by Vectis on R. 305 grounds) were discussed but deferred to a later submission. The Court ordered that the case proceed according to the RoP and that Dolby file a further submission.
