The Court of Appeal (judge-rapporteur Rombach) determined the correct court fee for AIM's appeal against a Helsinki Local Division order that disposed of a discontinued application for provisional measures (only the cost allocation remained live). It held that, because R. 360 RoP governs applications for provisional measures and R. 363.2 RoP renders a decision taken pursuant to R. 360-362 RoP a final decision within the meaning of R. 220.1(a) RoP, the appeal is a R. 220.1(a) RoP final-decision appeal — not a R. 220.1(c) RoP appeal concerning provisional measures. The Table IV fixed fee (EUR 14,600) plus the Table V value-based fee (EUR 5,800, on the EUR 800,000 maximum recoverable costs) therefore applied, so AIM's precautionary payment of EUR 20,400 was necessary and sufficient. The Court added that Registry completion of formal requirements in the CMS is not a final determination that all formalities and fee obligations are satisfied.
