routine
Sitting as a full panel, the Paris Local Division dismissed Adobe's application under R. 333 RoP to review the judge-rapporteur's order of 24 April 2026, which had rejected the defendants' requests to declare inadmissible — or summarily reject — KEEEX's request for an interim award of damages (a provision of EUR 120m) made in its Reply of 5 March 2026. The panel held that the request did not breach the parties' procedural protocol (the order of 8 September 2025 expressly preserved the claimant's option to seek a provisional award even though final damages were deferred to a separate R. 125 procedure), and was not late under the front-loading principle (R. 9.2) since it followed the claimant's renunciation of its final damages claim. It rejected summary dismissal under R. 334(f) and (h), the request not being manifestly devoid of prospects, and refused leave to appeal under R. 220.2 because the issue turned on a case-specific interpretation of a procedural protocol with no evident bearing on the harmonised application of procedural rules across UPC divisions.
