⚖️Infringement Action
🌐English

ENGLISH: The claimant’s legitimate interest in the publication of a decision (Art. 80 UPCA) may, depending on the circumstances of the individual case, follow from the fact that the defendant has marketed the attacked embodiment by explicitly referencing to the key technology protected by the patent.

notable
The Düsseldorf Local Division decided an infringement action together with the counterclaim for revocation on the merits. It rejected every validity ground — insufficiency, added matter, invalid priority, lack of novelty and lack of inventive step — and maintained the patent as granted, so the auxiliary requests needed no examination. It found literal infringement of the apparatus claim on the strength of the Defendants' own advertising material, holding that an 'offering' under Art. 25(a) UPCA is an economic concept and that a device incorporating the claimed structural features infringes even as an inferior embodiment. It granted a permanent injunction over Germany, France and the Netherlands, rejecting a proportionality defence built on patients' interests, and granted the full Art. 67 UPCA information and accounting order, recall including from commercial end users, destruction of the products, a declaration of joint and several damages liability, and publication of the decision in restricted form. It refused permanent removal from the channels of commerce for want of concrete measures, destruction of dual-use manufacturing tools and advertising materials, an interim award of damages, and any order for enforcement security.

Nichtigkeitsgründe

Art. 138 EPC
5 Gründe
Novelty
Art. 54 EPC · Art. 138(1)(a) EPC
Patent survived (this ground)
“The novelty attacks on claims 1 and 7 over CC 10, CC 15 and the further citations all failed; the technical teaching is novel [188]-[213]. The counterclaim for revocation is dismissed in item I of the operative part, so the ground did not succeed.”
Inventive Step
Art. 56 EPC · Art. 138(1)(a) EPC
Patent survived (this ground)
“Obviousness failed from every asserted starting point (CC 4, CC 6, CC 7 with combinations); CC 7 is not a realistic starting point, lies in a different field, addresses a different problem and teaches away [215]-[250]. Counterclaim dismissed.”
Added Matter
Art. 123(2) EPC · Art. 138(1)(c) EPC
Patent survived (this ground)
“The Art. 123(2) EPC attack failed. The change of claim category from an x-ray tube to a breast tomosynthesis system and the omission of the anti-scatter grid are directly and unambiguously derivable from the application as filed and no inextricable link was shown [149]-[169].”
Insufficiency of Disclosure
Art. 83 EPC · Art. 138(1)(b) EPC
Patent survived (this ground)
“The Art. 83 / 138(1)(b) EPC attack failed. Applying Amgen v Sanofi, the 'static focal spot' and the 'focal spot controller' are disclosed sufficiently for the skilled person to reproduce the invention; functional features need no instruction for every conceivable embodiment [129]-[148].”
Priority
Art. 87 EPC · derivative
Patent survived (this ground)
“The priority attack failed. Applying the G 2/98 same-invention test, claim 1 and method claim 7 are directly and unambiguously derivable from US 117453 P of 24 November 2008; the alleged de-linking of the controller's function from its coupling was not made out [170]-[187].”
