In a consolidated interim conference under R. 105.5 RoP for two parallel Fraunhofer infringement actions and their revocation counterclaims, the Hamburg Local Division issued a case-management order fixing the value of each proceeding (€3m including counterclaim) and regulating the closing exchange of pleadings ahead of the oral hearing. The most significant ruling concerns the sequencing of FRAND-defence submissions: the Court held that the patentee, as counter-defendant to a FRAND defence, is entitled to the final word to ensure a 'fair trial', and accordingly admitted the claimant's R. 36 RoP FRAND submission while dismissing the defendant's request for a further reply.
