On BYD's application under Rule 158 RoP the Hague Local Division ordered the US claimant BMSI to provide security for costs in an infringement action over EP 3 393 001. BMSI did not oppose the provision of security in principle, disputing only the amount and timeframe. The court set the security at 50% of the value of the proceedings; because the values of the infringement and counterclaim actions had not yet been determined and the parties disagreed only on the counterclaim value, it fixed the figure at EUR 350,000 — between BYD's EUR 400,000 request and BMSI's EUR 300,000 offer. BMSI was given four weeks (rather than the seven it sought) to provide the security, by deposit or EU bank guarantee, with a default-decision warning under Rule 355 RoP.
