The Hague Local Division (judge-rapporteur Kokke) dismisses an R.9.3 RoP application by the Transsion defendants to extend, by reference to an open-ended trigger event (service of a confidentiality order under R.262A RoP), the deadline for the combined non-technical Statement of Defence — including the FRAND defence — in three parallel Ericsson SEP infringement actions. The court reaffirms that R.9.3 RoP must be construed narrowly: extensions require exceptional circumstances and must be limited in scope, and an open-ended extension conditional on an external event is not appropriate. Concrete factors weighed against the extension were the timing of the application (one week before the deadline, which had been set three months earlier), the fact that defendants' representatives have had access to the confidential material since February 2026 and the expert since April 2026, the defendants' two-month delay in responding to the confidentiality application, and the foreseeability of multi-jurisdictional capacity strain on a global corporate group. The court emphasises that the UPC's front-loaded nature does not foreclose later submissions when new facts arise from in-house access (a further written round can be granted).
