⚖️Counterclaim for revocation
🌐English

ENGLISH: 1. Where an infringement action is filed in respect of acts occurring prior to the expiry of the patent and the possibility of claiming retroactive damages is at issue, the defendant has a legal interest in filing a counterclaim to revoke that patent, even if it has already expired. That legal interest arises from the infringement action brought by the claimant, since, under Article 47(6) of the UPCA, any person affected by a patent may bring an action in accordance with the Rules of Procedure. 2. The holder of a sub-domain is responsible for the content of the sub-domain as much as for the content of the main domain, either for offering or placing on the market the infringed products.

notable
The Lisbon Local Division held that a defendant retains a legal interest in a counterclaim for revocation after the patent has expired, because the infringement action reaches acts before expiry and exposes it to retroactive damages (Art. 47(6) UPCA, Art. 65(4) UPCA). On the merits it found added matter in claim 1 as granted through an intermediate generalisation of the symmetry feature, but held that auxiliary request 1 cured the defect and was clear under Art. 84 EPC and R. 50.2 RoP, and it then rejected every novelty and inventive-step attack, holding in particular that a document from the antenna art is not a realistic starting point for an inductor on a semiconductor die. On infringement it applied the Court of Appeal's autonomous reading of "offer" in Belkin v Philips and held that the holder of a domain and its national sub-domains answers for the content of the sub-domains as it does for the main domain, expressly refusing to transpose the Court of Appeal's stricter rule on the personal liability of directors to an undertaking. It declared liability in damages, ordered a full Art. 67 UPCA account within ten weeks under penalty, and refused to suspend the decision pending appeal.

Nichtigkeitsgründe

Art. 138 EPC
4 Gründe
Novelty
Art. 54 EPC · Art. 138(1)(a) EPC
Patent survived (this ground)
“Every novelty attack failed. Zhou and Jovenin use two loops in parallel and so lack the single conductive path of features 1.3 and 1.4; Bhattacharjee lacks the symmetry axis (1.2) and the terminal connection (1.5); Einzinger discloses neither 1.2 nor 1.5 on either FIG. 2 or FIG. 3; Taniguchi discloses an antenna on a substrate, not an inductor on a semiconductor die (1.1B) [148]-[174]. The ground did not succeed.”
Inventive Step
Art. 56 EPC · Art. 138(1)(a) EPC
Patent survived (this ground)
“The inventive-step ground failed from every starting point. Einzinger is a realistic starting point, but the modification proposed was an oversimplification that also contradicts Einzinger's own teaching of three cross-conductors; Taniguchi is not a realistic starting point because antennas and inductors are distinct devices operating at frequencies a factor of 1000 apart; Zhou, Bhattacharjee and Lees do not address the objective problem [175]-[194]. The burden on the party asserting invalidity was not discharged.”
Added Matter
Art. 123(2) EPC · Art. 138(1)(c) EPC
Partially invalid (this ground)
“The ground succeeded against the patent as granted and failed against the maintained form. Feature 1.2 requires only that the inductor be symmetric about any axis, omitting the symmetry between the two loops that WO328 presents as necessary for cancellation of the EM far-field — an unallowable intermediate generalisation, so the patent is invalid as granted [100]-[104]. Auxiliary request 1 adds feature 1.6 and overcomes it; the attacks on features 1.1A, 1.4 and 1.5 failed [92]-[123].”
Clarity
Art. 84 EPC · derivative
Patent survived (this ground)
“The clarity objection to auxiliary request 1 failed. Clarity of an amendment is examined under Art. 84 EPC through R. 50.2 RoP, and here feature 1.6 rests on the description rather than on a granted dependent claim, so the Court did examine it — and held the claim clear notwithstanding the argued ambiguity about the relationship between the "first predefined axis" and the symmetry axis of feature 1.2 [108]-[117].”
