The Düsseldorf Local Division (Judge-Rapporteur Schumacher) dismissed Defendants' post-judgment application for a R. 262A RoP confidentiality order over the sales, customer and cost information they had been ordered to disclose under Art. 67 UPCA / R. 191 RoP. The Court confirmed that R. 262A RoP applies mutatis mutandis to information ordered under Art. 67 UPCA (following EOFlow v Insulet, UPC_CoA_930/2025), but held the application inadmissible: where defendants can reasonably foresee that the requested orders may require disclosure of confidential information, they must raise confidentiality during the merits proceedings, so that appropriate protective measures can be embedded in the operative part. Filing post-decision is generally inadmissible. The Court additionally held that restricting the use (as opposed to mere access) of disclosed information is a matter of substantive law that must be settled at the merits stage and cannot be retrofitted in enforcement, citing the Court of Appeal in Kodak v Fujifilm.
