⚖️Application for an Order for inspection pursuant to RoP199
🌐German

When deciding on a request to change the language of the proceedings to the language of the patent on grounds of fairness, all relevant circumstances – in particular those related to the case and the respective position of the parties – shall be considered. If the outcome of balancing of interest is equal, the position of the defendant is the decisive factor. Efficient communication among defendants without the need to rely on translations, which represents a significant disadvantage in terms of costs and delays, is all the more important in the context of accelerated proceedings.

routine
The President of the CFI granted HyGear's request to change the language of proceedings from German to English in inspection proceedings before the Düsseldorf LD. Applying the CoA framework, the court balanced all relevant circumstances and found that the Dutch defendant's need for efficient communication without translation burdens — especially in accelerated proceedings — outweighed TU Munich's preference for German. English was the predominant language in the relevant technology field and most parties either consented or operated in English.
