⚖️Application for provisional measures

DEUTSCH: 1. // ENGLISH: 1. An independent process claim and the corresponding description can only be relevant when determining the scope of protection of an independent product claim if the patent specification indicates that it also describes characteristics of the claimed product. 2. An injunction covering the making of a product may also be issued if the infringing product has so far been manufactured by a third party outside the contracting member states.

notable
The Düsseldorf Local Division granted provisional measures against three Menarini distributors over EP 1 962 668 B1 (implantable sandwich sensor). On construction, the panel held that the patent is its own lexicon: the claimed electrode comprises the electrode system and the electrode contact layer as one multi-layer unit, and where a substrate has more than one width the width relevant to the entire-width feature is the width in the region of the electrode layers, not the bulk width. Because claim 1 is a product claim, the route of manufacture is in principle irrelevant; an independent process claim and the corresponding description bear on product-claim scope only where the specification indicates that they also describe properties of the claimed product (headnote 1). Validity was sufficiently certain under R. 211.2 RoP, priority was validly claimed and the novelty and inventive-step attacks failed, and the applicants had not delayed unreasonably under R. 211.4 RoP, there being no general market-monitoring duty. The injunction extends to making although the product is currently made by a third party outside the contracting member states (headnote 2); custody with a bailiff was ordered under R. 211.1(b) RoP; and the information order was granted only for origin and distribution channels, information serving the calculation of damages being outside the reach of provisional measures.

Nichtigkeitsgründe

vorläufig ·Art. 138 EPC
3 Gründe
Novelty
Art. 54 EPC · Art. 138(1)(a) EPC
Preliminarily survived
“The novelty attack failed at the R. 211.2 RoP standard. WO '447 (Art. 54(3) EPC prior art) does not directly and unambiguously disclose feature 1.4; its figure 3 shows a different, single-plane construction and the combination of isolated dimensional values is arbitrary [221]-[242]. US '006 is not prior art given the valid priority and in any event discloses an in-vitro test strip, not an implantable sensor [243]-[254]; the late US '871 / US '137 attack fails on feature 1.4 [255]-[257].”
Inventive Step
Art. 56 EPC · Art. 138(1)(a) EPC
Preliminarily survived
“The inventive-step attack failed. Applying the CoA framework of UPC_CoA_464/2024 and UPC_CoA_528/2024 [260]-[267], the panel found that neither US '871 alone nor in combination with US '999, WO '790, WO '447, US '006 or the common general knowledge, nor WO '424, makes the claimed solution obvious at the degree of probability required for provisional measures [268]-[310].”
Priority
Art. 87 EPC · derivative
Preliminarily survived
“The attack on the priority of P1 (EP 05 027 755, 19 December 2005) failed. Applying the same-invention standard of Art. 87 EPC as stated in UPC_CFI_1/2023, UPC_CFI_115/2024 and UPC_CFI_461/2024 (Dolle v Fakro, headnote 1), the panel held features 1.2, 1.2.1 and 1.2.2 directly and unambiguously derivable from P1 [199]-[218]. The consequence is that WO '447 remains Art. 54(3) EPC prior art only and US '006 is no prior art at all.”
