v.
Sinocare et al. - UPC_CFI_624/2025
1. Patent claims sensor assembly and kit for continuous glucose monitoring. Preliminary injunction deemed urgent and necessary to prevent entry of reimbursement segment of the market.
2. Requested declaration that the infringing products are "goods suspected of infringing an intellectual property right" (Art.2(7)(a) of Regulation (EU) No 608/2013) dismissed.
3. Some (parts of) requested additional corrective measures dismissed as not urgent or unnecessary or disproportionate
notable
The Hague Local Division granted a provisional injunction over a unitary patent on continuous glucose monitoring, and in doing so drew a line through the information order that other divisions have granted whole. Disclosure of origin and distribution channels is urgent and necessary, because it lets the patentee prevent further infringement by third parties; disclosure of prices, sales volumes, costs and profits serves only the calculation of damages and is premature at the provisional stage. Jurisdiction over the Chinese manufacturer rested on Art. 71b(2) with Art. 7(2) Brussels Ia, the manufacturer being named in the Eudamed entry and in the user guide and having announced a joint European launch with the distributor. On construction, 'distal' means away from the user's hand rather than resting on the skin, and a seal 'shaped to enclose' the contacts is not confined to the two-half embodiment of Fig. 34 — which distinguishes this patent from the family member the Court of Appeal construed in Abbott v Sibio, where the figure was written into the claim. The validity defences on novelty, inventive step and sufficiency all failed.

Nichtigkeitsgründe
vorläufig ·Art. 138 EPCNovelty
Preliminarily survivedArt. 54 EPC · Art. 138(1)(a) EPC
“The novelty attack over the Dexcom patent family, taking US 7,905,833 B2 as reference, fails [40–41]. In the Dexcom system the sensor, the sharp and the seal sit in separate sub-assemblies after manufacture and before insertion: the sharp belongs to the needle sub-assembly inside the applicator and meets the contacts sub-assembly only during the moment of insertion. Claim 1 requires the sharp to be part of the sensor assembly itself (feature 1.5), so the prior art does not disclose the claimed assembly or the claim 15 kit.”
Inventive Step
Preliminarily survivedArt. 56 EPC · Art. 138(1)(a) EPC
“The obviousness attack fails [48–51]. The Dexcom family discloses an entirely different applicator system whose components cooperate and connect in an entirely different way, and the division could not see how the skilled person would modify it to arrive at claim 1 or claim 15. There is no incentive to bring the sharp together with the other claimed features before insertion, which would require a completely different insertion procedure with differently designed components. WO 2011/119896 A1 does not disclose the role of its 'compressed anisotropic zebra', still less as a seal enclosing the contacts portion.”
Added Matter
Not decidedArt. 123(2) EPC · Art. 138(1)(c) EPC
“The added-matter objection was directed at claims 2, 6–8, 10 and 12–15, with no objection to claim 1 and an unsubstantiated objection to claim 15 [55]. Since the division had already found claims 1 and 15 likely to be held valid, it saw no need to address added matter on the remaining dependent claims.”
Insufficiency of Disclosure
Preliminarily survivedArt. 83 EPC · Art. 138(1)(b) EPC
“The insufficiency attack was conditional on the applicant's broad reading of feature 1.6 [52–54]. The division adopted essentially that reading and still found the disclosure sufficient: the description gives concrete examples of a seal enclosing the contacts portion, either with two elastomeric members in the sensor assembly or with one in the assembly cooperating with one in the socket of the electronics assembly. The wording of feature 1.6 is commensurate with the scope of the invention as described.”
