The requirement of an extreme urgency under R 223 RoP has to be established by the applicant. In the present case, the applicant has not evidenced the existence of an extreme urgency.
The Court of Appeal dismissed the application for suspensive effect (without hearing the respondent), stating that the applicant failed to show extreme urgency. The court further explained that the order was not "manifestly wrong" which could have justified ordering the suspensive effect.
