Düsseldorf LD Panel 1 (Thomas presiding + JR) ordered the release of the EUR 200,000 security for costs deposited by Curio Bioscience in the 10x Genomics v Curio infringement action (EP 2 697 391). Following the merits decision of 16 June 2025 (infringement of claim 14, injunction, recall/destruction, information and damages — costs 30/70 between the parties) and the cost decisions of 2 February 2026 (UPC_CFI_657/2025; UPC_CFI_658/2025) — none of which has been appealed — Curio paid the amount due to 10x Genomics and applied for release of the security on 2 April 2026. 10x Genomics raised no objection. Applying R. 352.2 RoP by analogy, the Court released the security on the basis that the Claimant has no continuing interest in retaining it.
