1. The reduction of the damages sought in an infringement action should be considered as a change of the claim, more precisely as a limitation of the claim, and if it is filed with due explanation and unconditionally must be granted by the Court, pursuant to Rule 263 (3) ‘RoP’.
The Paris Central Division decided that a reduction of the amount of damages requested by the plaintiff should be considered a limitation of the claim and must be granted pursuant to rule 263.3 if filed unconditionally and with due explanation. The court rejected the request to reconsider the court fees already paid by the claimant based on the initial, higher amount.
