The lack of a valid representation of a party requires the Court to grant that party an opportunity to remedy the deficit and, therefore, does not lead to the declaration of the inadmissibility of the action or the application filed by this party.
In this order following the decision that Suinno Mobile was not sufficiently represented (Court of Appeal's order of 8 February 2024, UPC_CoA_404/2023), the Paris Local Division rejected the application to dismiss the action as manifestly inadmissible. The Court stated that the party that was represented insufficiently must be given the opportunity to remedy the deficit.
