v.
Easee et al. - UPC_CFI_525/2024
1. Article 69(4) UPCA does not provide for an obligation on the part of the Defendant to provide security.
2. A Claimant can request a Defendant to provide security for costs to the extent that it concerns the counterclaim for revocation as a Defendant acting as Counterclaimant falls within the scope of Art. 69(4) UPCA.
The Hamburg Local Division partially granted an application for a security for legal costs against the Defendant, but only insofar as the counterclaim for revocation is concerned. In the extensive order, the Court went into detail regarding the rules on security and clarified its stance towards ordering a security from the Defendant.
