1. If a time limit provided for in the Rules of Procedure or set by the court has been missed, the party may only file an application for restitutio in integrum pursuant to Rule 320 of the Rules of Procedure, which takes precedence over Rule 9.3 of the Rules of Procedure. 2. The standard of due diligence pursuant to R. 320.1 of the Rules of Procedure is to be interpreted autonomously. Due diligence (“all due care”/“toute la viglance nécessaire”) is generally met if the party has taken all reasonable precautions to enable it to meet the deadline.

The Hamburg Local Division granted an application for the re-establishment of rights (Rule 320) after the party's representatives had missed the deadline for filing a cost application (Rule 151). The Court found that the representatives had exercised the required due diligence with their system for deadline control and, thus, granted the re-establishment of rights.
