When it comes to the number and individuality of persons authorised to have access the number generally should not be larger than necessary to comply with the right of the parties to an effective remedy and a fair trial. 2. The interest of formulating a universal strategy for international disputes, also regarding forums outside of the UPC Member States and even outside of the EU, might be advantageous for a Claimant. But this interest cannot be seen as essential for litigating the present case and therefore does not outweigh the Defendants’ interest in confidentiality.
