Zusammenfassung: The Munich Local Division allowed the claimant to withdraw its infringement action against two of four defendants following a settlement, holding again that Rule 265.1 RoP covers a withdrawal directed at only some of several defendants. The withdrawing defendants had consented to the withdrawal and to the costs order but objected to the claimant's accompanying assertion that the claims against the two remaining defendants rested exclusively on chips they had made and sold. The Court held that disagreement irrelevant: those arguments concerned at most the proceedings of the other defendants and disclosed no legitimate interest of the consenting defendants in having their own proceedings continue. Costs followed the parties' agreement, each side bearing its own.
