The Munich Local Division permitted Network System Technologies to withdraw its infringement action as against defendants 3) and 4) under Rule 265.1 RoP after an out-of-court settlement, and declared the proceedings closed. Rule 265.1 RoP allows withdrawal until a final decision has issued unless the other party has a legitimate interest in the action being decided; both defendants consented and the Court found no other reason to continue. Under Rule 265.2(c) RoP the Court still issues a cost decision and must take a costs agreement into account, so it ordered that attorney's fees, court fees and expenses be borne by the party incurring them, as the parties had agreed. The value of the action was set at EUR 2,000,000. This is one of three parallel decisions the same panel issued on the same day on three different patents (UPC_CFI_513/2023, 514/2023 and 515/2023), each under its own order number.
