In provisional-measures proceedings the Hamburg Local Division granted, on an interim basis, an application under Rule 262A RoP to protect confidential information. The information consisted of the names of natural persons employed by the defendant's customers. The Court reasoned from Art. 9(1) and (2), second subparagraph (a) of Directive (EU) 2016/943, which allows access to documents containing business secrets to be restricted to a limited number of persons on request, to Art. 58 UPCA and its implementation in Rule 262A RoP, and held that Art. 58 UPCA provides for the protection of personal data as confidential information. Names of natural persons are personal data within the meaning of the GDPR, whose processing is restricted by Arts. 5 and 6 GDPR, and must be protected as such. The claimant, given the opportunity to comment, raised no objection. Access was restricted to the applicant's representatives and their teams until a final order is made, the material may not be used or disclosed outside the proceedings save where lawfully obtained elsewhere, and a culpable breach may attract a penalty payment.
