The judge-rapporteur of the Paris Central Division permitted the withdrawal of an application for a cost decision and closed those proceedings. The application had been filed by the claimant in one of nine revocation actions between NJOY and the Juul group, seeking recoverable costs of EUR 10,000; the parties then agreed a global settlement of the cost issues in all nine actions, under which each side withdraws its applications for a cost decision and each bears its own costs. The Court found no impediment to permitting the withdrawal and declaring the proceedings closed under R. 265(2)(a) RoP, and held that, the agreement being undisputed, no decision on the costs of the cost proceedings themselves under R. 150 RoP et seq. was needed either. The decision rests on R. 265(1) and (2)(a) RoP in conjunction with R. 156(2) RoP.
