The Court recorded that the parties had not asked for the agreement to be kept confidential under R. 365.2 RoP, so the confirmed settlement becomes part of the public file by default. It made no order as to costs, noting only that the parties had agreed on costs and requested none. On the claimants' further application it directed the Registrar to reimburse 60% of the court fees, EUR 22,200 of EUR 37,000, because the settlement was reached before the closure of the written procedure.
