The judge-rapporteur of the Hamburg Local Division granted the defendants' unopposed application under R. 262A RoP to classify the figures for representation and expert-opinion costs in their brief of 21 July 2025 as confidential information. The Court grounded the protection in Art. 9(1) and (2), second subparagraph, point (a) of Directive (EU) 2016/943, implemented by Art. 58 UPCA and R. 262A RoP, and applied the R. 262A.6 RoP ceiling that the confidentiality club must be no larger than the right to an effective remedy and a fair trial requires while containing at least one natural person per party and their representatives. Access was limited to the applicant's UPC representatives and three named in-house legal functions, who are bound to confidentiality even towards their own company and even after the proceedings end, on pain of a penalty payment for each culpable breach. The Court further excluded the information from publication under R. 262.1(a) RoP and from any public file-access request under R. 262.3 RoP, and declined to grant leave to appeal ex officio because R. 220.1 RoP makes such an order unappealable on its own.
