notable
The judge-rapporteur of the Hamburg Local Division rectified a procedural order of 5 August 2025 on the defendants' application under R. 353 RoP. The Division restated the rule: on its own motion or on a party's application made within one month of service, and after hearing the parties, the Court may rectify clerical mistakes, errors in calculation and obvious slips; 'obvious slips' covers every incorrect or incomplete statement of what the Court actually intended, so that the declaration of intention in the order must depart from the intention held when it was made. Two such errors were found in a confidentiality order made under R. 262A RoP in a rehearing cost procedure: it referred to sections A.I. and A.III. instead of A.I. and A.II. of the cost application of 21 July 2025, and it covered costs for expert opinions although none had been included in that application. Because the errors were obvious, the judge-rapporteur held it unnecessary to hear the opposing party before rectifying, and directed the Registry to attach the correction to the original so that it becomes an integral part of the decision.
