The Deputy-Registrar, acting for the Registrar, reviewed the refusal to enter an applicant on the UPC list of representatives under Art. 48(2) UPCA. The petition was admissible: it was filed in writing with the Registrar in an official EPO language inside the one-month period and stated its reasons (R. 300(c) RoP and Part IV of the EPLC Rules). It was nevertheless unfounded, because the qualifications listed in EPLC Rules 11 and 12.1(a) are exhaustive — during the transitional year ending 3 June 2024 no course or certificate outside that list, however equivalent its curriculum, could be recognised as an 'other appropriate qualification'. The Registrar declined to rectify and forwarded the petition to the President of the Court of Appeal for a final decision under EPLC Rule 19.
