Panel 1 of the Munich Local Division closed a whole dispute in a single decision after the parties settled: the infringement action, the counterclaim for revocation and a separate application for a cost decision left over from earlier provisional-measures proceedings were all withdrawn, the proceedings declared closed and the decision entered on the register. No cost decision was required, as each side asked. Because the written procedures had not yet closed, the Court directed the Registry to refund 60% of the court fees to the claimant and 60% to the defendants. The decision is reasoned in two sentences and cites no provision at all, neither R. 265 RoP for the withdrawals nor the reimbursement rule; the 60% rate is only available under R. 370.9(b) RoP in its version in force before 1 January 2026. A pending application for a cost decision is treated like any other action for these purposes and can simply be withdrawn. The published heading names the cost proceeding as UPC_CFI_326/2024, while the subject-matter line and the operative part both give UPC_CFI_326/2025.
