Application to produce evidence under Rule 190 RoP rejected.
The Munich Local Division rejected an application for the production of evidence by Defendants in infringement proceedings. The Defendants requested that the Claimant produce specific data regarding an expert report. The Court rejected the application as "inadmissible or at least unfounded", stating that the Defendants had not substantiated that the evidence was indeed required for their non-infringement argument which, at this stage, was not even presented.
This order was published twice identically as it applied to two parallel applications by the different Defendant groups.
