Public access to the register granted (R. 262.1 RoP). Application of criteria set forth in Ocado v AutoStore (ORD_19369/2024, UPC_CoA_404/2023).

routine
The Hague Local Division (judge-rapporteur Brinkman) granted a Powell Gilbert LLP R. 262.1(b) RoP request for public access to the written pleadings and evidence in the closed preliminary-injunction proceedings EP 3 831 283 (Abbott v Sibio/Umedwings). Applying the Court of Appeal's Ocado v AutoStore framework (UPC_CoA_404/2023), the court held that the public's general interest in understanding and scrutinising the decision ordinarily outweighs party interests once the first-instance proceedings have concluded, and that a pending appeal does not revive the "integrity of proceedings" rationale for withholding the first-instance file. The court refused to filter access based on whether arguments had been addressed in the decision and refused confidentiality for annexes absent a timely R. 262A request or specific confidentiality reasons. A 15-day stay was ordered and leave to appeal granted.
