The Munich Local Division, sitting as a panel on a R. 333 RoP application for review, confirmed the judge-rapporteur's decision under R. 20.2 RoP that the defendants' preliminary objection under R. 19 RoP be dealt with in the main proceedings rather than separately. Two grounds carried the order. First, procedural economy: the identical preliminary objections and the identical FRAND part of three parallel actions between the same parties on different patents were to be heard together, and the defendants had not challenged the corresponding R. 20.2 RoP notifications in the two sibling cases. Second, and more substantively, the objections raised went to the compatibility of the UPC Agreement with the TEU and the TFEU and to the effective institutionalisation of the Court — objections that question the legitimacy of the UPC itself and therefore require the panel's in-depth consideration, which can properly be given only at the main hearing. Leave to appeal was refused.
